Our terms and conditions

These Terms of Service ("Terms") are an agreement between you and InfoMason ("InfoMason," "we," "us," or "our") and govern your use of the Jessy website, app, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

These Terms include a binding arbitration agreement and a class-action waiver (Dispute Resolution). They affect how disputes between you and us are resolved. You may opt out of arbitration within 30 days of first accepting these Terms.

What Jessy Is

Jessy is an AI-powered career service. You hold ongoing conversations with an AI career agent that learns about you, surfaces job opportunities it considers well-matched, and coaches you on your search. Jessy is a tool to support your job search — it is not an employer, a staffing agency, or a recruiter acting on your behalf, and it does not guarantee any job, interview, or other outcome.

Who Can Use Jessy

You must be at least 18 years old to use the Service. By using it, you represent that you are 18 or older and have not been previously suspended or removed from the Service.

Jessy is intended for individuals located in the United States, running their own job search. An account is for a single individual — you may not share your account, let anyone else use it, or use the Service on someone else's behalf.

Your Account

You're responsible for keeping your account credentials confidential and for all activity that happens under your account. Tell us promptly at info@jessy.jobs if you suspect unauthorized use. We are not liable for losses caused by someone else using your credentials.

You agree to provide accurate information. Providing false information — including in your conversations with the agent or in anything that may be shared with an employer — may result in suspension or termination.

License to Use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own job search. We may update, change, or discontinue features at any time.

AI Features and Their Limits

The Service is fundamentally AI-driven. Your conversations, your job matching, the insights you receive, and any written summaries about you are generated with the help of artificial intelligence. You should understand the following:

  • AI output is for informational and assistive purposes only. It may be inaccurate, incomplete, or not suited to your situation.
  • You are responsible for reviewing and verifying anything the AI produces before you rely on or act on it, including before approving anything to be shared with an employer.
  • AI output is not professional advice. It is not legal, financial, or professional career counseling, and it is not a guaranteed job-search strategy.
  • We make no promises about employment outcomes. Whether you receive interviews or offers depends on many factors beyond Jessy's control, including employers' own decisions. We do not guarantee any job, interview, response, or result.
  • AI output may contain errors or biases. We do not warrant that AI-generated content is free of inaccuracy or bias.
  • You are responsible for what you approve to share. You must review the accuracy of any summary about you before approving it to be shared with an employer; we are not responsible for inaccuracies in content you approve.

Sharing With Employers

A feature that lets the agent share your profile with employers is not yet live. If and when we launch it, the agent will share your profile with a company only with your explicit approval, you will be able to see and edit what would be shared before it is sent, and we will update these Terms and our Privacy Policy first. We are not responsible for the decisions, actions, or omissions of any employer or other third party.

Your Content

You keep ownership of the content you provide to the Service — your messages, the information in your profile, and anything you upload ("Your Content"). You grant us, and our service providers acting on our behalf, a limited license to use Your Content solely to provide, maintain, secure, and improve the Service for you. This license ends when you delete the relevant content or close your account, except for copies retained as described in our Privacy Policy (for example, in backups or where we are required to keep records). Information we generate about you, such as inferences, is described in our Privacy Policy, which also governs how you can access and delete it.

We may also create aggregated or de-identified data from your use of the Service and use it for analytics and other business purposes. We maintain such data without attempting to re-identify you, and we do not sell it or use it to train AI models. Our right to use de-identified data continues after you close your account.

You are responsible for Your Content and represent that you have the right to provide it and that it is accurate.

Acceptable Use

You agree not to:

  • Use the Service for any unlawful, fraudulent, or abusive purpose.
  • Provide false or misleading information about yourself or your background.
  • Reverse-engineer, scrape, data-mine, or copy the Service, or probe or interfere with its security or systems.
  • Use the Service to build or train a competing product or service.
  • Upload anything that infringes others' rights or that is unlawful, or attempt to gain unauthorized access to any account or system.

Subscriptions and Payment

Jessy offers paid subscriptions. Payments are handled by a third-party payment processor; by subscribing you also agree to that processor's terms.

  • Auto-renewal. Paid subscriptions automatically renew at the end of each billing period at the then-current rate unless you cancel before the renewal date. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
  • Cancellation. You can cancel anytime through your account settings. Cancellation stops future charges and takes effect at the end of your current billing period; you keep access until then.
  • Refunds. Cancelling does not automatically entitle you to a refund of amounts already charged. We may consider refund requests on a case-by-case basis; submitting a request does not guarantee approval. This does not limit any non-waivable rights you have under applicable law.
  • Free trials and promotions. If we offer a free trial or promotional period, unless you cancel before it ends, your subscription will begin and your payment method will be charged at the then-current rate. We may change or end trials and promotions at any time.
  • Price changes. We may change subscription prices. We'll give you advance notice by email before a change takes effect on your renewal, and continuing to use the Service after that means you accept the new price.
  • Taxes. Prices exclude applicable taxes, which you are responsible for.

Our Intellectual Property

The Service, including its software, design, text, and trademarks, is owned by us or our licensors and is protected by intellectual-property laws. These Terms don't grant you any rights in our intellectual property except the limited license to use the Service.

If you send us feedback or suggestions, you grant us the right to use them without restriction or obligation to you.

Third-Party Services

The Service may rely on or link to third-party services and websites. We don't control them and aren't responsible for their content, practices, or availability. Your use of them is governed by their terms.

Termination

You can stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if we're required to by law, or to protect the Service or other users. We may also discontinue the Service. The sections of these Terms that by their nature should survive termination — including AI Features and Their Limits, Your Content, Our Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Dispute Resolution — will survive.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES REGARDING ACCURACY, RELIABILITY, OR AVAILABILITY. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any result — including any job-search outcome — will be achieved. Some jurisdictions don't allow certain warranty exclusions, so some of these may not apply to you.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, we and our affiliates and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost opportunities (including missed job opportunities), or loss of data, arising out of or relating to the Service.

OUR TOTAL LIABILITY for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (a) the total fees you paid us in the 6 months before the event giving rise to the claim, or (b) $100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, such as for gross negligence, willful misconduct, fraud, or personal injury. Some jurisdictions don't allow certain limitations, so some of these may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless InfoMason and its affiliates, officers, and employees from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your breach of these Terms, your Content, or your violation of any law or third-party right.

Dispute Resolution

Please read this section carefully — it affects your legal rights.

  • Informal resolution first. Before starting an arbitration, you agree to contact us at info@jessy.jobs and describe the dispute, and to give us 45 days to resolve it informally.
  • Binding arbitration. If we can't resolve it, you and we agree that any dispute arising out of or relating to the Service or these Terms will be resolved by final and binding arbitration administered by the American Arbitration Association under its applicable rules, rather than in court. The Federal Arbitration Act governs this agreement to arbitrate.
  • Jury and class-action waiver. YOU AND WE WAIVE THE RIGHT TO A JURY TRIAL, AND AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.
  • Carve-outs. Either party may bring a claim in small-claims court if it qualifies, and either party may seek injunctive relief in court to protect its intellectual property.
  • 30-day opt-out. You may opt out of this arbitration agreement by emailing info@jessy.jobs within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. Opting out doesn't affect the rest of these Terms.
  • Severability. If the class-action waiver is found unenforceable as to a particular claim, that claim will proceed in court, but the rest of this section still applies.

Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. Subject to the Dispute Resolution section, any claim that proceeds in court will be brought exclusively in the state or federal courts located in Virginia, and you consent to their jurisdiction.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we'll update the "Last updated" date and notify you through the Service or by email before they take effect. Continuing to use the Service after that means you accept the updated Terms. If you don't agree, stop using the Service.

Notice for California Users

Under California Civil Code Section 1789.3, California users are entitled to the following notice. The Service is provided by InfoMason, 9169 W State St #1174, Garden City, ID 83714. Current subscription prices are shown at sign-up and on our pricing page. You may contact us at info@jessy.jobs with any complaint about the Service or to request more information, or reach the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.

Miscellaneous

  • Entire agreement. These Terms and the documents they reference are the entire agreement between you and us about the Service.
  • Severability. If any provision is found unenforceable, the rest stays in effect.
  • No waiver. Our failure to enforce a provision isn't a waiver of it.
  • Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
  • Electronic communications. You consent to receive communications from us electronically, and agree that electronic agreements and notices satisfy any legal requirement that they be in writing.
